Iddah in the Case of Miscarriage

Question:

Salam MOulana,

I have a question regarding a womans iddah (waiting period) after death of husband

So if a womans husband was to pass away and she was pregnant already. Thereafter during the iddah she had a miscarriage, then how will such a woman pass her iddah?

Answer:

In the name of Allah, Most Compassionate, Most Merciful,

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In principle, a pregnant woman’s iddah (waiting period) is the duration of pregnancy until the birth of the child.Allah Ta’ala says in the Qur’an:

وَأُولَاتُ الْأَحْمَالِ أَجَلُهُنَّ أَنْ يَضَعْنَ حَمْلَهُنَّ (سورة الطلاق: ٤)

Translation:And for those having pregnancy, their term (iddah) is that they give birth to their child.

(Surah Al-Talaaq: 4)

As for a woman who is not pregnantand her husband has passed away, then her iddah (waiting period) will be 4 months and 10 days. Allah Ta’ala says in the Qur’an:

وَالَّذِينَ يُتَوَفَّوْنَ مِنْكُمْ وَيَذَرُونَ أَزْوَاجًا يَتَرَبَّصْنَ بِأَنْفُسِهِنَّ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا (سورة البقرة: ٢٣٤)

Translation: Those of you who die, leaving their wives behind, they they (the wives) shall remain by themselves (in iddat) for four months and ten days. (Surah Al-Baqarah: 234)

If a widow experiences a miscarriage during her iddah, then the state of the foetus will determine whether a her iddah has expired or not. If the limbs of the foetus were partially formed, then her iddah will terminate due to the miscarriage. However, if the limbs of the foetus were not formed at all, then the woman will have to complete the 4 months and 10 days of iddah.[i]

 وشرط انقضاء هذه العدة أن يكون ما وضعت قد استبان خلقه أو بعض خلقه فإن لم يستبن رأسا بأن أسقطت علقة أو مضغة لم تنقض العدة؛ لأنه إذا استبان خلقه أو بعض خلقه فهو ولد فقد وجد وضع الحمل فتنقضي به العدة، وإذا لم يستبن لم يعلم كونه ولدا بل يحتمل أن يكون، ويحتمل أن لا يكون فيقع الشك في وضع الحمل، فلا تنقضي العدة بالشك

وَشَرْطُ انْقِضَاءِ هَذِهِ الْعِدَّةِ أَنْ يَكُونَ مَا وَضَعَتْ قَدْ اسْتَبَانَ خَلْقُهُ، فَإِنْ لَمْ يَسْتَبِنْ خَلْقُهُ رَأْسًا بِأَنْ أَسْقَطَتْ عَلَقَةً أَوْ مُضْغَةً لَمْ تَنْقَضِ الْعِدَّةُ كَذَا فِي الْبَدَائِعِ.

 قال الحاكم في الكافي إذا قال لها إذا ولدت ولدا فأنت طالق فأسقطت سقطا قد استبان بعض خلقه طلقت ألا ترى أن العدة تنقضي بمثله وتصير الأمة بمثله أم ولد فإن لم يستبن خلقه لم يقع به طلاق ولم تنقض به عدة ولم تصر به أم ولد. اهـ
